The SEC has proposed amendments to its rules to enhance and standardize disclosures regarding cybersecurity risk management, strategy, governance, and incident reporting by public companies. Specifically, the SEC proposed a new rule that requires “Market Entities,” including broker-dealers, clearing agencies, major security-based swap participants, and transfer agencies to implement procedures to boost their ability to manage cybersecurity risks. Financial Services companies are also one of the sixteen critical infrastructure sectors regulated by the Cybersecurity and Infrastructure Security Agency (CISA) under the Cyber Incident Reporting for Critical Infrastructure Act of 2022 (CIRCIA). Finally, though most regulations use vague standards to hold companies accountable for their cybersecurity practices, The New York Department of Financial Services (NYDFS) Cybersecurity Requirements for Financial Services Companies mandates that regulated entities comply with a prescriptive list of cybersecurity requirements. 

This panel will provide various points of view on how to comply with these cybersecurity requirements, including from leadership within organizations instituting compliance mechanisms. The discussion will focus on how companies can navigate these various areas of regulation by providing recommendations on best practices and risk mitigation strategies. What you’ll take away: Discussion of how to address the requirements in each of the regulations that apply to financial services companies, including how to measure risk; Insights on the new proposed SEC Regulations; and Practical tips on how to create compliance mechanisms that address the shared qualities of the various regulations.
